POLICE RESERVE PROGRAM PROPOSAL

As a result of the World Trade Center Disaster is imperative that cities and law enforcement agencies nationwide utilize all available resources at their disposal to protect its citizens.
With the atrocities witnessed in New York City on September 11, 2001, it is especially essential for the New York City Police Department to be prepared for further terrorist actions and have a civil defense force
accessible which is superior to none. This means garnishing every available resource at their disposal, including trained, retired law enforcement professionals and a Reserve police force capable of responding to
It is proposed by the author, Sgt. Bennett Mormino, NYPD (Retired), that the New York City Police Department, City of New York and State Legislature operate as one body to improve the Police
Department's resources by implementation of a Police Reserve program within the New York City Police Department. The writer drafted a detailed Police Reserve Program in 1995 after the World Trade Center bombing of
1993. A copy of the plan was forwarded to the Police Commissioner at that time, but the plan was never addressed or adopted. However, the times and needs of the City of New York and its police department have
changed since September 11, 2001 and a program that affords additional seasoned law enforcement professionals could only be an asset to the department's operational capabilities.
The Police Reserve Program will be designed to serve as a ready-trained "Reserve Force" that could be mobilized on short notice in case of natural disasters, civil disorders or
national attack. The police Reservists will also be utilized throughout the community to assist the department in accomplishing its mission. The reservesí role is that of riding as a "second person" with
regular officers during routine patrol and continued to supplement the patrol force at community activities and major emergencies. The men and women who will serve as Reserve officers represent retired members of
the service and/or a cross section of the community if they have no prior police service and who are interested in serving the City of New York to make it a safer and better community.
A carefully selected and welltrained Reserve police force, similar to those enjoyed by the various United States Armed Forces needs to be maintained by the New York City Police Department to
thwart future terrorist actions or threats. The police Reserves will be manned by experienced retired police officers and supervisors from the New York City Police Department, together with interested civilians.
Reserve officers will primarily supplement the Patrol Division field forces, performing those duties regularly carried out in precincts. Reservists may also be used to assist the Detective
Bureau and Records Divisions, and to perform any assignment, at the direction of the Police Commissioner. Police Reserve officers will continue to work under the philosophy of community policing to include
responsibility for protecting persons and property; maintaining order; preventing crime and juvenile delinquency; controlling traffic; specialized administrative or investigative duties; and writing reports.
Additionally, Reserve officers are encouraged to develop ongoing working relationships with community members to improve the quality of life within the City of New York.
Membership in the New York City Police Reserve will be for an indefinite period. Membership however, will cease when a Reserve officer attains the age of 63, similar to the current
requirement for active members of the department.
Reserve officer candidates will either be honorably retired police officers and supervisors, civilians wishing to contribute to the safety and wellbeing of their community, along with
individuals who wish to work in law enforcement prior to seeking a fulltime police career.
Reserve officers may be dismissed at will.
Civilians wishing to be Reserve officers must meet the same basic appointment requirements as that of Regular officers and go through the same selection process. The City will cover the cost
of physical, medical and psychological tests in the hiring process. Initial police academy training will be exempt for retired police officers. Civilians wishing to become Reserve officers will be required to attend
the New York City Police Academy in the same manner as those recruits becoming fulltime active Police Officers. The cost of police academy training for citizens wishing to become Reserve officers will be their
individual responsibility. However, police academy costs can be deferred, and then waived once the Reserve officer completes five (5) years of honorable Reserve service. If the recruit fails to complete five (5)
years of honorable service as either a Reserve officer or subsequent active police officer, repayment of the deferred police academy curriculum cost would become their responsibility. This policy would be similar to
the guideline associated with the current Police Cadet program. The cost of future training would then be covered by the New York City Police Department.
Active police officers wishing to enlist in the Reserve program upon retirement will be given the opportunity to demonstrate their desire during the end phase of their careers. A UF49
addressed to the Commanding Officer, Police Reserve Section will be prepared and forwarded 60 days prior to the completion of their official procedure at the Pension Section. Reserve acceptance and assignment will
be approved on a first come, first served basis when vacancies exist. If no vacancy exists when a member retires, the uniformed member will be placed on a preferred, Reserve officer eligible list and assigned on a
first come, first served basis when vacancies arise.
As is customary with current police examinations, Reserve officer candidates with no prior police service will be required to take a reasoning multiplechoice test. The Reserve officersí
examination will be the same test as for fulltime police officers. After passing the police officer examination and at the time of their appointment investigation, applicants would indicate whether they wish to
either become Fulltime or Reserve officers.
Scores on the test will be used to determine their place on an eligible list
The multiplechoice test may include questions, which require the use of any of the following abilities:
understanding written sentences and paragraphs.
using English words or sentences in writing so that others will understand.
remembering information, such as words, numbers, pictures and procedures. Pieces of information can be remembered by themselves or with other pieces of information.
being able to tell when something is wrong or is likely to go wrong. It includes being able to identify the whole problem as well as elements of the problem.
adding, subtracting, multiplying and dividing quickly and correctly.
applying general rules to specific problems and coming up with logical answers. It involves deciding if an answer makes sense.
combining separate pieces of information, or specific answers to problems, to form general rules or conclusions. It involves the ability to think of possible
reasons for why things go together.
following correctly a rule or set of rules or actions in a certain order. The rule or set of rules used must be given. The things or actions to be put in order
can include numbers, letters, words, pictures, procedures, sentences, and mathematical or logical operations.
determining where you are in relation to the location of some object or to tell where the object is in relation to you.
imagining how something would look when it is moved around or when its parts are moved or rearranged. It requires the forming of mental images of how patterns or objects
would look after certain changes, such as unfolding or rotation. One has to predict how an object, set of objects, or pattern will appear after the changes have been carried out.
No official of the City of New York City, whether appointed or elected, may be a member of the New York City Police Reserve.
Reserve officers who live within New York City will be assigned to the Borough Command where they reside, or one of it's neighboring Borough Commands. If a Reserve officer resides in one of
the outlining counties, the Commanding Officer, Reserve Section will seek to assign the officer to a Borough Command where vacancies exist and as close to their home as practical.
Education and Experience Requirements:
By the date of appointment, an applicant must have either:
- Successfully completed 60 semester credits at an accredited college or university with a 2.0 cumulative index or its equivalent, or
- A fouryear high school diploma or its educational equivalent and have completed two years of honorable fulltime U.S. military service.
- Honorably retired from the New York City Police Department.
- Priority for appointment as a Reserve officer will be granted to retired members of the New York City Police Department, followed by applicants who qualify for the Legacy Credit,
citizens with prior law enforcement experience and then citizens with no prior law enforcement background.
Candidates will qualify for the "Legacy Credit" if his or her parent has died while engaged in the discharge of his or her duties as a uniformed member of the New York City Fire
Department, New York City Police Department, New York City Transit Police Department, New York City Housing Authority Police Department or New York City Department of Correction. All such claims will be
An eligible must have attained age 21 to be appointed as a Reserve Police Officer. Police Reserve eligibles who are too young for appointment on the date the eligible
list is terminated will have no further opportunity for appointment from this list. Only persons who are less than 35 years of age on the first date of the application period for this examination may be appointed to
Reserve Police Officer. Thus, a candidate must not have reached his or her 35th birthday to be appointed as a Reserve Police Officer. An applicant who is at least 17 Ĺ years of age by the last date of the
application period is permitted to apply for this position.
Exception to Age Requirements:
All persons who were engaged in military duty as defined in Section 243 of the New York Military Law may deduct from their actual age the length of time
spent in such military duty provided the total deduction for military duty does not exceed six years.
United States citizenship is required at the time of appointment to Reserve Police Officer.
Character and Background:
Proof of good character and satisfactory background will be absolute prerequisites to appointment. The following are among the factors which would ordinarily
be cause for disqualification: (a) conviction of an offense, the nature of which indicates lack of good moral character or disposition toward violence or disorder, or which is punishable by one or more years of
imprisonment; (b) repeated convictions of an offense, where such convictions indicate a disrespect for the law; (c) discharge from employment, where such discharge indicates poor behavior or an inability to adjust
to discipline; (d) dishonorable discharge from the Armed Forces; and (e) conviction of petit larceny. In accordance with provisions of law, persons convicted of a felony or domestic violence misdemeanor are not
eligible for appointment to the title of Reserve Police Officer.
Medical and Psychological Assessment: Medical and psychological guidelines will be established for the position of Reserve Police Officer. Candidates will be examined to determine whether
they can perform the essential functions of the position of Reserve Police Officer. Additionally, employees will be expected to continue to perform the essential functions of the position of Reserve Police Officer
throughout their careers, and may, therefore, be medically and psychologically tested periodically throughout their careers. Where appropriate, a reasonable accommodation will be provided for a person with a
disability to enable him or her to take these medical and psychological examinations, and/or to perform the essential functions of the job.
Physical standards established for the position Reserve Police Officer will be the same as for active police officers. Eligibles will be required to pass a qualifying
physical test, and may be required to undergo periodic physical testing throughout their careers.
Eligibles must pass a drug screening in order to be appointed. All eligibles for Reserve Police Officer will be drug tested prior to appointment as part of a
preemployment screening process. All probationary Reserve Police Officers are subject to drug testing during Police Academy Training and as part of the medical examination at the end of probation. Reserve Police
Officers may again be drug tested on a random basis after their probationary periods are completed or as a prerequisite for assignment or promotion. Any member of the NYC Police Department found in possession of or
using illegal drugs, or who fails, refuses, or attempts to evade a drug test, will be terminated. The NYC Police Department has a strict zero tolerance policy concerning illegal drug use. Individuals who are
considering applying for positions in the NYC Police Department are expected to conform their behavior to this policy well before they begin the application process.
On the date of appointment as a Reserve Police Officer, possession of a valid unrestricted New York State driverís license is required.
The New York State Public Officers Law would require that any person employed as a Reserve Police Officer in the New York City Police Department must be a
resident of the City of New York or of Nassau, Westchester, Suffolk, Orange, Rockland or Putnam counties.
Candidates must be able to understand and be understood in English.
Proof of Identity:
Under the Immigration Reform and Control Act of 1986, you must be able to prove your identity and your right to obtain employment in the United States prior to
employment with the City of New York. Driver License is required. Employees must maintain such license during their employment.
The probationary period for this title is 24 months. Among other requirements, each appointee will be required to pass the Police Academy firearms, academic,
physical performance, and driving tests, and meet disciplinary and performance standards throughout the probationary period. The probationary period may be extended pursuant to New York Civil Service Law and the
Personnel Rules and Regulations of the City of New York.
Membership Contact Information:
New York City Police will typically recruit for vacant Reserve Officer positions at various times throughout the year. The process is dictated by the
need to fill open, authorized positions. Interested individuals will be encouraged to contact the Police Reserve Coordinator.
Reserve officers' will function under the direct authority of the Police Commissioner. While working as a Reserve officer, they are under the direct supervision of a shift operations
supervisor. Reserve officers are bound by the same policies and procedures, as are the Regular Officers.
Chain of Command
A Reserve Coordinator/Commanding Officer, Reserve Section will be responsible for the overall command, training, and operation of the Reserve Organization. This position will coordinate the
Reserve activities with their respective Borough Chief, and the Chief of Patrol. The Police Commissioner is the overall commander of the Reserve Unit.
A Reserve Liaison officer will be a regular Police Department officer and appointed by the Police Commissioner. His or her duties will be to assist and advise the Reserves in all phases of
organization, training and operation. The Liaison officer will work closely with, and report to, the Reserve Coordinator/Commanding Officer, Reserve Section.
The Liaison officer, Reserve Coordinator/Commanding Officer Reserve Section, and other ranked Reserve officers will comprise the Reserve Staff.
The Police Commissioner will choose the Reserve Coordinator/Commanding Officer Reserve Section and Liaison officer positions. They are rotating positions, 3 years for the coordinator and 2
years for the Liaison officer.
Reserve Officer supervisors will be appointed as Reserve Commanders/Supervisors, with the same rank as when retired. He or she will be responsible for the management of all Reserve
activities within their assigned shift.
One or more Reserve officers may be appointed to their respective rank at the time of retirement, to assist the Reserve Commander/Commanding Officer Reserve Section in administration,
training, and coordination of the Reserve unit.
All requests for nonemergency, routine police Reserve services or duty will be directed to the Reserve Coordinator/Commanding Officer Reserve Section or the Liaison officer.
The New York City Police Reserve will be comprised, as many members of various ranks deemed necessary by the Police Commissioner to carry out the reserve mission.
All requests for emergency police Reserve services will be directed through the affected Borough Commander and forwarded to the Chief of Patrol for authorization after conferring with the
Police Commissioner, or his or her designee.
All requests for nonemergency, routine police Reserve services or duty will be directed to the Reserve Coordinator/Commanding Officer Reserve Section or the Liaison officer.
Uniforms/ Uniform Cost
The City will furnish and maintain a uniform allowance for Reserve members the same amount as enjoyed by fulltime active members. These uniforms will be the same as Regular Officers, except
a small Reserve patch will be worn above the New York City Police Department Patch on the left and right arms.
All Reserves will be required to initially purchase their own protective vest, weapon, and duty gear if they do not already have departmentapproved equipment. The vest will be replaced when
needed by the City as determined by the department.
Their badge will have "Reserve Officer" on it.
When acting as a New York City Police Reserve, officers are to have their badge and identification card on them at all times.
Reserve Officers will be compensated for normal training, patrol time, or other worked details. When being paid, the rate of pay will be on a per-diem basis and the same hourly/daily amount
as those enjoyed by active members of the service of the same rank and time of service, to include overtime at the rate of time and a half for more than eight (8) hours of duty performed. A member of the police
Reserve will receive compensation for his or her membership while on duty during monthly and yearly work/training periods and/or when the Police Commissioner declares an emergency, such as natural or other
All expenditures for work performed will be in the form of currency. Reserve officers will not be allowed to accumulated time. Additionally, Reserve officers cannot accrue chart days, be
granted holidays or other days off, except when a fullscale mobilization is declared by the Police Commissioner, the Reserve officer is mobilized and the Reserve officer has worked more than 14 straight days without
time off. At that time, the reserve officer may be granted, as the needs of the department warrant, one day off per week until the crisis subsides.
Paid Detail Unit
Any outside offduty paid police work must receive prior approval of the Reserve Commander. Reserve officers would be eligible to participate in the New York City Police Department's Paid
Work Related Injuries/Compensation
While on duty as a Reserve officer, each individual will be covered by Workers Compensation Insurance for work related injuries and under the City's liability policy, as long as they are
acting within the scope and responsibility of this position
Duties and Responsibilities
When serving on active duty at the call of the Police Commissioner or other competent authority, members of the New York City Police Reserve will be entitled to all the powers and privileges
of regular Police Officers within the City and State of New York, and subject to all the duties, regulations, and responsibilities thereof.
Reserve officers are to know all Departmental Orders, Operations and Reserve Program Manuals and keep them up to date. Officers will be subject to all laws, policy, procedures, rules and
regulations affecting officers of the New York City Police Department.
Reserve officers, when on regular duty with the New York City Police Department, will be under the supervision of the New York City Police chain of command, to include certified Police
Officers, at all times.
All Reserve officers are subject to emergency call up, and the performance of such police duties as may be assigned them. All other times Reserve officers are subject to the standard two
days per month and two weeks (14 days) per year.
No Reserve will participate in patrol duty or any special details while off work from their regular employment due to illness or injury, or if they have any condition that could prevent a
Regular Officer from working.
Reserve officers are required to attend all scheduled Reserve work, training classes and/or meetings each month. They are required to put in a minimum of 2 days each month, at least 8 hours,
which will be in a patrol capacity along with two additional weeks (14 days), at least 7 days, which will be in a patrol capacity.
A minimum of 8 hours and a maximum of 16 hours will be worked on any regular patrol shift. Exceptions to this requirement may include circumstances where the reserve has made an arrest and
processing and/or court time precludes the officer from completing his or her tour within the 16hour time frame.
If the Reserve is working a patrol shift, and has worked 8 hours or more at another job within the past 12 hours, then he or she will not work more than 8 hours. The shift supervisor may
authorize emergency exceptions to this requirement after conferral and approval with the Reserve Coordinator/Commanding Officer Reserve Section.
Any Reserve unable to complete the Reserve requirements for more than two consecutive months, will apply for a leave of absence. Such requests will be submitted in writing to the Reserve
Coordinator/Commanding Officer Reserve Section. No request will be granted for more than 6 months.
Reserve granted leaves might still be required to attend Reserve training classes and meetings. Upon returning from a leave, they may be subject to additional training and patrol time before
they will be granted full status at the class level they had attained prior to the leave.
Limitation on Powers
Except when on duty by call of the Police Commissioner, or other competent authority or for normal training/active duty purposes, the members of the Police Reserve will perform no police
functions other than those granted to all citizens of the state of New York by the laws thereof.
Rights and Powers While on Active Duty
While serving on active duty at the call of the Police Commissioner or other competent authority, members of the Police Reserve will be entitled to all the powers and privileges of a regular
Police Officer and subject to all the duties and regulations and responsibilities thereof. And the responsibility of citizens to assist the Police Officers in pursuit of their duty will apply to the members of the
Police Reserve while on active duty in the same manner as to any other Police Officer.
Members Subject to Call at all Times; Exception as to Labor Disputes
Members of the New York City Police Department Police Reserve will at all times be subject to call and performance of police duties as may be assigned to them, (except in the case of labor disputes in which case they may voluntarily refuse to serve) and will report for duty at such intervals and times as will be fixed or determined by order of the Police Commissioner.
Discipline, Chain of Command and Dismissal
Members of the Police Reserve Program will be subject to the order of the regularly constituted authority of the City and will be directly responsible to the Police Commissioner and officers
of the regular police department under his command and to the officers of the police Reserve. Members will serve at the pleasure of the Police Commissioner and may be dismissed with or without cause by the Police
City Property to be Returned Following Termination of Membership
Upon termination of membership in the Police Reserve for whatever reason, all property of the city in the possession of the member will be surrendered and delivered to such official as the
Police Commissioner will designate to receive the same.
A complete and continuing training program is to be conducted for all Reserve officers. Training and instruction of the Reserves will be under the supervision and control of the Reserve
Coordinator/Commanding Officer Reserve Section, Reserve Liaison officer, and the Department Training Officer.
All new civilians wishing to become Reserves will start at a recruit level Reserve Police Officer but can request a review for upgrade based upon their education, training, and experience.
All new Reserves will work with an approved Field Training Officer for a minimum of six (6) months, to be determined by their experience, training, and classification level.
Reserve officers will attend an approved Police Academy before appointment to the New York City Police Reserves. Exceptions to this can be made based on prior police or Reserve police
training and experience.
Reserves may attend any departmental inservice training classes, if openings exist. Requests for training classes will be made through the Reserve Coordinator/Commanding Officer Reserve
Section, Reserve Liaison officer, and the Department Training Officer.
Pension/Pension Supplement Option
As a member of the Reserve officer program, it will be understood that there will be no additional supplement to a memberís pension and the current pension enjoyed by former active members
will be protected. All pay received will be made on a per diem basis and will be based on their current rank and time in service.
As an incentive to join the Reserve officer program, the City of New York may provide a daily annuity payment, which is 3X the amount currently enjoyed by active members of the same rank. Upon termination of honorable police Reserve service, a member will have the opportunity to withdraw the accumulated annuity as a pension supplement.
As is customary with current police promotional examinations, all Reserve candidates with no exceptions will be required to take a reasoning multiplechoice test to advance to the next
highest rank. The Reserve officer Sergeant, Lieutenant, and Captain promotional examinations will be the same test as for fulltime active members of the service. After passing the promotional examination, scores on
the test will be used to determine their place on an eligible list and as opening arise for the respective rank, promotions may be granted.
Promotional opportunities for the ranks of Deputy Inspector and above will be granted at the discretion of the police commissioner as openings arise for the respective rank.
As a member of the Reserve officer program, it is understood that all members will make a payment to their respective unions on a monthly basis. Payment is to be based on the percentage of
pay that is currently being deducted by active members of the service.
Membership in the New York City Police Reserve will be divided into 4 classifications, starting with a Recruit Reserve (Class 4), and progressing to a Class 1 Reserve.
Class 4 Reserve Civilian's wishing to become Reserve Officers
After completion of the application and selection process, and the swearing in, a Reserve will be a "recruit" and will remain at this level until advanced to another
classification, resigns, or is terminated.
- 1 Must attend NYPD Police Academy training.
- Attend department inservice training or other approved police training to include at least the following topics: Criminal and traffic law, patrol procedures, social science, driver
training, firearms class and range qualification, felony and vehicle stops, arrest laws and procedures, and defensive tactics. Reserve Staff may assign additional training.
- After completing the above requirements, a Reserve may wear the police uniform and ride on patrol with assigned Regular/Training Officers.
- 4 All service and membership times mentioned in this order can be from any approved police or Reserve service unless specifically stated otherwise.
- 5 All Reserve Officers will be assigned a 24month probationary period.
Duties and Responsibilities
- Ride on patrol with assigned Field Training Officer or Regular Officer.
- May assist in special assignments as approved by the Department.
- After 3 months minimum uniform patrol time, may work a special detail with another Reserve of Class 2 or higher.
- After 6 months of satisfactory service and satisfactory completion of classroom training pertaining to defensive driving and department vehicle operation may drive for another Regular
Officer, or Class 1 Reserve, with their approval. Reserve Coordinator staff will approve this prior to driving.
Class 3 Reserve Civilian's wishing to become Reserve Officers
- Completion of an approved Police Academy
- At least 24 months of Reserve membership
- Satisfactory completion of Class 4 probation and approval of the Reserve Coordinator Staff and 2 Patrol Supervisors
- Will not remain a Class 3 Reserve for a period of more than 2 years or can be terminated
Duties and Responsibilities
- May assume duties of a Regular Officer, while under his supervision
- May work special details alone when assigned
- With 6 months driving experience in patrol and driving with another officer may be evaluated by 2 Patrol Supervisors as to ability to drive on transport details. Prior to this time, the
Reserve will also have completed at least 3 jail transports with another officer
- May ride with a regular police officer
- Perform such functions as assigned and may take a 2man Reserve car for special functions, with a Class 2 or higher Reserve, as approved by the Reserve Coordinator and Shift Supervisor.
- Continue to train
Class 2 Reserve
- A minimum of 3 years experience
- Have completed at least 25 additional hours of training over the Class 3 requirements
- Satisfactory completion of Class 3 requirements and approval of the Reserve Coordinator Staff, 2 Patrol Supervisors and Operations Division Commander
- No requirement to advance past Class 2 Reserve
Duties and Responsibilities
- May carry off duty weapon
- May drive to special assignments
- May engage in vehicle patrol duties as directed by the Reserve Coordinator and Shift Supervisor
- Can work a twoman Reserve unit and district assignment with another Reserve of Class 3 or higher
Class 1 Reserve
- Retired member of the New York City Police Department or 5 years minimum reserve time
- 50 hours or more additional training over Class 2 requirements
- Satisfactory completion of Class 2 requirements and an evaluation of knowledge and proficiency by Reserve Coordinator Staff and 2 Patrol Supervisors
- Approval of Commanding Officer, Reserve Section, Borough Commander and the Police Commissioner
Duties and Responsibilities
- Full patrol operation
- Assume authority and responsibility of Regular Officer, while on duty
- Assigned duties of any kind, independent of direct supervision
- Continue to maintain minimum participation and retain a level of training similar to that of a Regular Officer.
- Assist in training other Reserve officers
- Put in at least two days per month with 8 hours in patrol, and two weeks per year with 7 days on patrol.
While these Police Reserve membership classifications demonstrate the responsibilities of each Reserve Officer Class, it should be understood the ideal scenario is that one Reserve
officer and one Regular officer perform normal patrol duties. If the needs of the department change due to manpower shortages or emergency situations, then the option of utilizing one Class 1 Reserve and one Reserve
officer of a lower class may be implemented. Implementation may only commence after conferral and approval of the affected Borough Commander, Commanding Officer Reserve Section and the Chief of Patrol, or his
While the writer has attempted to deal with many of the issues that will be questioned concerning a New York City Police Reserve Program, he is convinced other uncertainties exist and will
need to be addressed. However, it is believed with politics aside, the implementation of Police Reserve Program would prove to be a positive feature within the New York City Police Department. It would augment the
current active force, promote a positive image, and provide seasoned law enforcement professionals at a time when we, as a city must strengthen our civil defense system to combat future terrorism or threats.
The writer welcomes the prospect of meeting police, union and governmental staff to expand this proposal into a workable plan. Any suggestions or recommendations to improve this proposal are
